Representative matters include:
- Represented financial institution in defense of class action over ransomware attack and breach of customer data and information at an entity of which the financial institution was a customer. Claims were dismissed at the motion to dismiss stage.
- Represented an internet services provider in a business disruption lawsuit alleging that a company was forced out of business because of actions taken by the internet service provider. Trial defense verdict on all claims.
- Represented an investor in an action against a financial institution trustee over its failure to safeguard viatical contract investments, which were converted and sold to another investor to the detriment of the original investor. Trial verdict obtained on behalf of client.
- Represented corporate client in recovery of millions of dollars deposited with a bank after the bank claimed several years later and after two mergers that it could not locate the client’s accounts in its system.
- Represented university in recovering millions of dollars from several sources in the U.S. and Hong Kong after fraudulent third party used a compromised email account to induce bank to unlawfully transfer funds to overseas accounts.
- Represented private equity fund portfolio companies in responding to attempted fraudulent wire transfers in real estate transactions and setting up protocols for future incident response.
- Represented non-profit in recovery of hundreds of thousands of dollars that were improperly wired out of the client’s account after the bank was notified of a fraudulent wire scheme directed at the client.
- Represented financial institution in an action based on employee theft of customer information, including claims of unfair trade practices, breach of confidentiality, breach of fiduciary duty, negligence, and negligent supervision.
